Restraining Orders & Domestic Violence
A domestic violence charge is not something to take lightly. If you are convicted, it can affect your relationship with your children, your employment opportunities and your right to own firearms. You need a lawyer to investigate the case against you and argue for solutions that do not include jail time.
At Jayne Law Group, P.C., we defend people charged with serious violent crimes, such as domestic violence, in California. In addition, we file and respond to all restraining orders, including domestic violence, workplace violence, civil harassment and elder protective orders. While you can file these orders on your own, it is better to work with an attorney. Our firm has had considerable success with restraining orders and domestic abuse defense. In particular, of-counsel to the firm, Terry Szucsko, is a family law specialist and is extremely experienced in defending and filing civil harassment orders.

Protective Orders And Restraining Orders
Protective orders and restraining orders are extremely common in domestic violence cases. An emergency protective order (EPO) can be obtained immediately and can last up to seven days. It may include temporary child custody orders and can require that you move out of your home.
Temporary restraining orders may also be granted and are valid until your next court date. If the judge decides to continue the order, it may last for up to five years. If you violate a restraining order or EPO, you could be arrested and found in contempt, which is a misdemeanor offense. Penalties include up to a year in jail and a $1,000 fine.
We also assist people who need to file restraining orders and EPOs. It is important to note that you do not need a green card to get a restraining or protective order. We can help you with the order and refer you to immigration lawyers.
Domestic Violence And Domestic Abuse Charges
We represent people charged with misdemeanor and felony domestic violence. Because police will often arrest the accused even if the accuser retracts his or her statement, you need legal representation.
Our attorneys will investigate the accuser and find out what happened. When possible, we can help reunite the family and refer individuals to alcohol or drug rehabilitation and counseling.
