Protective Orders And Restraining Orders

Protective orders and restraining orders are extremely common in domestic violence cases. An emergency protective order (EPO) can be obtained immediately and can last up to seven days. It may include temporary child custody orders and can require that you move out of your home.

Temporary restraining orders may also be granted and are valid until your next court date. If the judge decides to continue the order, it may last for up to five years. If you violate a restraining order or EPO, you could be arrested and found in contempt, which is a misdemeanor offense. Penalties include up to a year in jail and a $1,000 fine.
